The man convicted of kidnapping, drugging and repeatedly sexually assaulting an 11-year-old Armstrong, B.C., girl three years ago will appeal the ruling.
Paul Robert Lepage, 58, is also appealing last month's decision by B.C. Supreme Court declaring him a dangerous offender.
The Crown says LePage's appeal documents cite an "error in law" and request the conviction and dangerous offender designation be overturned.
A panel of the B.C. Court of Appeal will consider the application but dates for the hearing have not been set.
Lepage was found guilty in February 2008 of luring his young victim from outside an Armstrong video store with a story about catching a mouse. He injected her with cocaine and sexually assaulted her during 36 hours of confinement.
Lepage has multiple convictions dating back to the 1960's. A forensic psychiatrist testified he would pose an extremely high risk to the community.
